Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Mohtam (مُهتم) platform ("the Platform", "we", "us", "our"), a Saudi-based platform for building websites, managing restaurants, and running online shops. By using the Platform or creating an account, you agree to be bound by these Terms. If you do not agree to any of these Terms, please do not use the Platform.

1. Acceptance of Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Platform on behalf of a business entity, you represent that you are authorized to accept these Terms on behalf of that entity. You must be at least 18 years old to use the Platform.

2. Account Registration and Responsibilities

To use the Platform's services, you must create an account and provide accurate, complete, and up-to-date information. You are responsible for:

  • Maintaining the confidentiality of your account credentials, including your password.
  • All activities that occur under your account, whether authorized by you or not.
  • Notifying us immediately upon discovering any unauthorized use of your account.
  • Keeping your account information current and accurate at all times.

We reserve the right to suspend or terminate any account that contains inaccurate or misleading information.

3. Acceptable Use Policy

When using the Platform, you agree not to:

  • Publish or distribute content that is illegal, harmful, abusive, defamatory, or in violation of Saudi regulations and Islamic principles.
  • Send unsolicited messages (spam) or bulk marketing communications without recipients' consent.
  • Engage in fraudulent, deceptive, or misleading activities.
  • Infringe upon the intellectual property rights of others.
  • Attempt unauthorized access to Platform systems or other users' accounts.
  • Use the Platform for any purpose that violates applicable laws or regulations.
  • Upload files containing viruses or malicious software.

We reserve the right to remove any content that violates this policy and to suspend or terminate the violating account.

4. Intellectual Property

4.1 User Content

You retain all intellectual property rights to the content you create on the Platform, including text, images, designs, and product data. By creating content on the Platform, you grant us a limited, non-exclusive license to host, display, and distribute this content solely for the purpose of providing the service.

4.2 Platform Ownership

The Platform and all its components, including software, designs, trademarks, logos, and original content, are the exclusive property of Mohtam. Your use of the Platform does not grant you any ownership rights in the software or underlying technologies.

5. Payment Terms

5.1 Subscriptions

The Platform operates on monthly or annual subscription plans. Fees are calculated in Saudi Riyals (SAR) and billed at the beginning of each billing cycle. Subscriptions renew automatically unless you cancel before the end of the current billing period.

5.2 Wallet System

The Platform provides an electronic wallet that you can top up and use to pay for services such as domain registration and add-ons. Wallet balances are non-refundable and do not accrue interest.

5.3 Refund Policy

You may request a refund within 14 days of your initial subscription only, provided the service has not been extensively used. Fees related to domain registration or third-party services are non-refundable. Refund requests are processed within 14 business days.

6. Service Availability

We strive to ensure the Platform is available around the clock, but we do not guarantee uninterrupted or error-free service. The service may be temporarily unavailable due to:

  • Scheduled or emergency maintenance.
  • System updates and improvements.
  • Circumstances beyond our control, such as third-party service outages or natural disasters.

We will make reasonable efforts to notify you in advance of any planned downtime.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Platform is provided "as is" and "as available" without any express or implied warranties. We are not liable for:

  • Any direct, indirect, incidental, or consequential damages arising from your use of the Platform.
  • Loss of data, profits, or business opportunities.
  • Any damages resulting from acts or omissions of third-party service providers.
  • The accuracy or completeness of AI-generated content.

In all cases, our total aggregate liability to you shall not exceed the amount you have paid to us during the preceding twelve (12) months.

8. Account Termination

8.1 Termination by User

You may close your account at any time through your account settings. Upon closure, your data will be deleted 30 days after the closure date. During this period, you may request a data export.

8.2 Termination by Platform

We reserve the right to suspend or terminate your account immediately and without prior notice in the event of:

  • Violation of these Terms or the Acceptable Use Policy.
  • Failure to pay outstanding fees.
  • Engagement in illegal or fraudulent activities.
  • A threat to Platform security or its users.

9. Governing Law

These Terms are governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia. Any dispute arising from or related to these Terms is subject to the exclusive jurisdiction of the competent courts in the Kingdom of Saudi Arabia.

10. Dispute Resolution

In the event of any dispute, both parties agree to attempt an amicable resolution within 30 days through direct negotiation. If the dispute is not resolved amicably, it shall be referred to the competent courts in the Kingdom of Saudi Arabia. You may also file a complaint through the National Unified Platform or the relevant regulatory authorities.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes at least 30 days before they take effect via email or a notice on the Platform. Your continued use of the Platform after the changes take effect constitutes your acceptance of the revised Terms.
